This memorandum is being issued to clarify how the SpecialProvisions for Working Schedule or Plan of Operations will affectthe schedule of DBE participation as required in SpecialProvision for Section 110.04 (d). This memorandum is shown assuperseding CD-95-10 which was never issued.
Special Provision for Section 110.04 requires the Contractorto submit a schedule showing the DBE participation, as apercentage of the contract value, which shall occur at thecompletion of each major component of work shown on theContractor's progress schedule or at the quarter points (onefourth, one half, etc.) of the original contract dollar amount,whichever is appropriate. On contracts containing either of theabove Special Provisions, the Department can only require thesubmission of a schedule showing participation at the quarterpoints. The Contractor, however, can be given the option tosubmit the schedule showing participation at the completion ofeach component should it be deemed advantageous.
